a) The Metropolis real estate agency has the following obligations towards the seller:

  • our broker will come to inspect the property and gather all the necessary documentation
  • with the seller’s permission, the broker will photograph the property to ensure the highest quality of presentation on our website and of marketing in general
  • our broker will enter into a listing agreement with the seller. This agreement is not exclusive, which means that you or any other real estate agency have the right to sell your property if you manage to find the buyer on your own, without any further obligations towards the Metropolis real estate agency
  • according to the general rules of business ethics, Metropolis will inform the seller of the offers received from the potential buyers. Once the seller and the buyer have reached an agreement, the agency will draft the preliminary contract and the sale contract
  • Metropolis will organize the signing of the preliminary contract and the sale contract
  • our broker will be present during the payment and takeover of the property
  • our broker will be present during the official signing of the loan agreement at the office of the notary public and during the purchase of the property with the bank loan
  • Metropolis will charge the seller 2% commission on the agreed price of the property

b) The Metropolis real estate agency has the following obligations towards the buyer:

  • our broker will present the buyer with the documents of ownership of the chosen property
  • the Agency will draft the preliminary contract and the sale contract
  • the Agency will organize the official signing of the contract by the seller and the buyer at the office of the notary public
  • if the price of the property is paid partly or fully with a bank loan, our broker will be present at the official signing of the loan contract at the office of the notary public
  • after the signing of the contract, our broker will deliver the proposal for the registration of deeds to the land registry department of the municipal court for the registration of the mortgage
  • our broker will be present at the payment of the agreed property price at the bank and at the takeover of the property

 

The expenses of the perspective buyer include the 2% agency fee and 5% property sale tax to be paid to the Republic of Croatia.

c) If the buyer is a foreign citizen, his expenses will include additional lawyer’s fee, depending on the extent and the course of the legal affairs, and the approval by the Ministry of the Foreign Affairs and the Ministry of Justice.

However, the foreign citizen who sets up a company in Croatia will automatically receive the status of a corporation and will not need to wait for the approval by the Ministries. In this case, the buyer has the right and the obligation to pay the 5% tax to the Republic of Croatia.

From February 1. 2009. EU citizens are allowed to purchase real estate in Croatia under the same terms as Croatian citizens.
